Remaining Relative Visa (Subclass 115)

It is a permanent resident visa specially crafted for those people whose all the near relatives have moved to Australia and only they are left in their homeland. The applicant can include only their partner and their or their partner’s child or stepchild under the family members in this visa application. However, at the time of applying for a visa application and at the time of visa grant the applicant must be offshore from Australia.

The applicant after being granted the visa can reside in Australia as a permanent resident and after fulfilling the requirements can even apply for Australian citizenship. For five years from the date of visa grant the applicant can easily leave and re-enter Australia.

Eligibility Requirements:

  • For applying this visa, the applicant’s as well as their partners near relatives must be citizen of Australia, Australian permanent resident or eligible citizen of New Zealand and living in Australia.
  • An eligible near relative or their spouse having minimum 18 years of age must sponsor the applicant and their complete family.
  • The applicant must have someone who provides assurance of support.

If any of your or your partner’s near relatives is unlawful or a holder of a temporary visa/bridging visa, then you won’t be considered eligible for this visa. Another point which makes you ineligible for this visa is your sponsor or their partner being a holder or sponsoring someone else in Remaining Relative (subclass 115 or 835), Family 806 visa or Preferential Family 104 visa.

The applicant’s near relative living in Australia will be considered eligible only if they are-
